Hi all,

Has anyone on this forum provided renderings for a law suit? I am wondering how to construct a proposal. I have been asked to provide renderings for an eminent domain case. And I am wondering how I should protect myself. I do not want to have to have to hire a lawyer to review the proposal. I mean it is a bit nerve racking because if for some reason the renderings were incorrect, I see where I could be in trouble.

Just wondering if anyone has any experience in this area and can provide some good advice.

Thanks Brian. I Do have some verbiage similar to this. This project is a bit different because it is to show the impact of a new freeway that will be taking away land through eminent domain. So I will be building the freeways, over passes, berms and embankments. The lawyers want to show how the new freeway is, not only taking away some of the land, but how it is also deminishing the value and intent of the site that is to be developed and it's visability from the main existing freeway. So I included some verbiage stating that I am creating this imagery from information given by third parties that I am not responsible for. So I am not responsible for incorrect or out dated information that may be given to me. that kind of thing...New territory for me...

9. INDEMNITY
Consultant agrees to defend, indemnify, save and hold the “Client”, its directors, employees, agents and other
consultants harmless from and against all costs, expenses (including reasonable attorneys’ fees and court costs, fines
and penalties), suits, actions, losses, liabilities, claims, damages and other charges incurred by the “Client” or the other
indemnified parties arising out of the act or omission of consultant, its resources, employees, officers or directors.
The scope of the foregoing indemnity includes any and all costs and expenses properly incurred in connection with any
proceedings to defend any indemnified claim, or to enforce the indemnity, or both. The indemnification provided herein
shall survive the termination of this agreement.

10. ATTORNEYS FEES
Should either party employ an attorney or attorneys to enforce any of the provisions hereof or to protect its interest in
any manner arising under this Agreement, or to recover damages for the breach of this Agreement, the non-prevailing
party in any action agrees to pay to the prevailing party all reasonable costs, damages and expenses, including
attorney fees, expended or incurred in connection therewith.

Unless they are paying you buko bucks for the renderings/visualization, I wouldn't fret too much over it.
