In MAX, go to render (#9, or F10) and then go to Render tab, SYSTEM rollout. There you will see the default mxs file predefined by Maxwell and you can change it. On top of that edit box, there is a checkbox for you to choose if you will automatically continue with rendering (MXCL) from inside MAX or you just save the MXS file to use it later from MXST.
What I want to say is that MXS is always written.

When you hit render MW creates the mxs file at the location specified at the system tab.
