"Opening a file while other running" Dialogue on 1st render

after I installed 2.5.1 i get this Dialogue when I start a render

this is all after installing 2.5.1 and a fresh reboot.

I then ran Sketchup first, exported a model, opened it in Studio to tweak a few settings, and quit studio because I didn't want it running in the background, then opened the .mxs with the Maxwell application and got the message.

I haven't tried different ways as yet to start a render, because the render I want is going at the moment.

the Dialogue says this.

Do you want to open it in other Maxwell instance?
{No} {Yes} [{Cancel}]

Hi,

This was done to avoid Maxwell opening a mxs while there is another mxi or render in memory. For example after tweaking some multi-light settings doing a double-click in another mxs file would clean the image and all the work would be lost.

Are you saying that Maxwell is showing this dialog even when you have just launched Maxwell?

That is correct.

I can reboot my computer and do nothing else related to Maxwell, double click on a MXS and get that message.
however if I launch a render from within Studio I do not.

I'm regretting upgrading, this version is very buggy for me. I can't open an Open File Dialogue for image environments either without a complete crash.... (in studio)
